CONSTRUCTION WORKER FILES WRONGFUL DEATH LAWSUIT
Audrey Franco, the widow of 36 year old Larry Franco and Olga Franco, his mother have filed a Wrongful Death Suit against Granite Construction Company, Yellowhouse Machinery Co., and Deere & Company for negligence and gross negligence in causing Mr. Franco’s death. On October 16, 2008, Mr. Franco, an employee of Granite Construction Company was working on a construction crew that was installing cement “wings” on a portion of the Marsha Sharp Freeway at Slide Road in Lubbock, Texas. Each individual “wing” weighed approximately 1 ton. At the time Mr. Franco was injured, another Granite employee was using a backhoe to hoist the cement “wing” when a hydraulic line on the boom of the backhoe ruptured. The cement “wing” fell to the ground and Mr. Franco was struck by the backhoe. He suffered severe injuries which ultimately lead to his death.
The backhoe was manufactured by Deere & Company and had been leased or sold to Granite by Yellowhouse Machinery Company.
The lawsuit was filed by the family this morning in Lubbock County District Court.
